Code Enforcement Board and Special Magistrate
 

The Code Enforcement Board (CEB) is a quasi-judicial body consisting of seven (7) citizens of unincorporated Hillsborough County appointed by the Board of County Commissioners to serve three (3) year terms.   The Code Enforcement Special Magistrates (CESM) are also quasi-judicial bodies comprised of one citizen each, of unincorporated Hillsborough County, appointed by the Board of County Commissioners to serve three (3) year terms.  The Board and the Special Magistrates have the same powers and duties and are empowered by Florida Statutes 162 and Hillsborough County Ordinance 05-5.

Several departments in Hillsborough County are charged with enforcing numerous Hillsborough County Codes and Ordinances such as the Land Development Code for zoning, signs, natural resources, and nuisance violations; the Property Maintenance Code; the Burglar False Alarm Ordinance; the Water Conservation Ordinance; and the Red Light Camera Enforcement Ordinance.  The citing department notifies the violator of the code or ordinance that is violated, identifies the remedy and gives them reasonable time to come into compliance.  If they fail to comply within the time allowed, the case is referred to Citizen Boards Support to schedule a hearing before the CEB or a CESM.

At the hearings, all testimony is taken under oath, all evidence and testimony are received and considered, and a decision is rendered at the hearing.  The decision is issued as a written “Order” and sent to the violator after the hearing.   The Order states the basic facts of the case, identifies the remedy and gives the penalty if compliance is not achieved in the time allowed.  If compliance is not achieved as ordered, a fine per day may be assessed, the Order may be recorded in the Public Record and will constitute a lien against the violator, any property that is in violation, and any other real or personal property owned by the violator.  The code fines will cease after compliance is achieved, but any accrued fines and any costs to prosecute the case will remain against the violator until satisfied.
